Termination
This agreement is effective until terminated by WhaleDeal.com, at any time without notice.
In the event of termination, you are no longer authorized to access our site and the restrictions
imposed on you with respect to material downloaded from our site, the disclaimers and limitations
of liabilities set forth in this agreement, shall survive.

Other
This agreement shall be governed by and construed in accordance with the laws of the State of Florida
without giving effect to any principles or conflicts of law. If any provision of this agreement shall
be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from
this agreement and shall not affect the validity and enforceability of any remaining provisions.

Account
Your use of this site construes your consent to maintaining the confidentiality of your account, including your
login and password information and that you agree to accept responsibility for all activities that occur under
your login and password. You further agree that you shall restrict access to the device or devices that you access
WhaleDeal.com from and take reasonable measures to protect your account and device(s). At no time shall you attempt to gain access to our systems
other than to maintain your account or to make purchases. You also agree that should you come upon or gain knowledge
of a breach in WhaleDeal.com security that it is your responsibility to notify us immediatley.

Risk of loss
All items purchased from WhaleDeal.com are made pursuant to a shipment contract. This means that the risk of loss and
title for such items passes to you upon our delivery to the shipping carrier.

Product Descriptions & Pricing
WhaleDeal.com and its merchants try to be as accurate as possible. However, WhaleDeal.com does not warrant that product descriptions
or other content of this site is accurate, complete, current, error-free, or reliable. If a product offered by WhaleDeal.com is
not as described, your only remedy is to return it in unused condition. With some products we cannot confirm the exact price
until after your order is placed. Your credit card is not charged until after your order has been confirmed for shipping unless
you have placed a back-order or pre-order or have agreed to your order status being set to one of those statuses, whether by e-mail
correspondence or verbally over the phone. If a product's correct price is lower than the price displayed, we will charge the lower
amount and continue with shipment. However, if the correct price is higher than the originally stated price, at our discretion we will
either contact you for a price adjustment before shipment, ship your order at our loss, or cancel your order and notify you of the cancellation.

Communication
You consent to receive communications from us electronically. We will communicate with you by e-mail, through notices posted on WhaleDeal.com,
or through other future channels established at this site. You agree that all agreements, disclosures, notices and other communications that
we provide to you through an electronic medium satisfy any legal requirement that such communications be in writing.

Modification & Severability
We reserve the right to make changes to our site, policies, and Terms & Conditions of Use at any time. If any of these conditions is to be deemed
invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of
any remaining condition.

Returns & Cancellations
All returns & cancellations are subject to a 15% restocking fee. This means that if you purhase an item or items(s) and you cancel or return your item
your refund will be your total amount less 15%. Please note that some items cannot be returned and these sales are considered final. Items
that are not defective may not be returnable.

Shipping
Shipping is currently restricted to the continental united states, for shipping outside of this region please email us at info@whaledeal.com.

A 6% sales tax will be added to your total for items being shipped to Florida. Please note that
shipping prices are calculated for the continental united states only, if you are shipping outside
of this region your order may be rejected or additional charges may apply. By submitting your order
you are agreeing to our terms and conditions and policies. Please note that some items are shipped from partner
warehouse's which may increase your shipping time. Some items in our stock list are shipped directly
from the manufacturer which may increase shipping and processing times. Please read all descriptions and notifications
of each item that you are purchasing. Street Addresses are required for shipping, orders with po boxes will not be accepted
and a partial refund only will be provided. Products that have quantities under 10 are not guarenteed to be in stock, in which
case a back-order will be placed for your order and you may receive a partial shipment. Some items are not returnable due to
manufacturers and or suppliers policies, we cannot except returns for these items.
